Henderson Reeves is committed to keeping your information safe and to ensuring compliance with its legal obligations under the Privacy Act 2020.  You have the right of access to, and correction of, your personal information held by us.

This Privacy Statement sets out how we will collect, store, use, disclose and protect your personal information.

Personal Information

We collect, store and disclose personal information for the purpose of conducting our business, to market our services and to meet our legal obligations, including in relation to our privacy obligations, client conduct and care rules and anti-money laundering compliance obligations.

Personal information is any information that can identify an individual. Depending on the nature of your relationship with Henderson Reeves, the personal information we will collect may include:

  • name, date of birth, address and contact details;
  • occupation;
  • payment details;
  • employment history;
  • education and qualifications;
  • financial information;
  • evidence of source of funds; and
  • any other information which assists us in conducting our business, providing and marketing our services and meeting our legal obligations.

Collecting Personal Information

We may collect personal information about individuals by email, phone, face to face meetings, from forms or other documents, via software and through our website.

Henderson Reeves has engaged third-party agents to assist with its Customer Due Diligence requirements under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML Act).

Our third-party agents may collect your personal information in accordance with the terms of this Statement and under all applicable laws. If we, or our third-party agents, are unable to obtain the requested information from you, or if you are unwilling to provide that information, we may be unable to act for you.

Our website may use cookies and similar technologies to improve your experience. Cookies collect information such as your IP address, browser type, pages visited, and time of visit. This information is used in aggregate form for analytical purposes and is not used to identify individuals.

Information Privacy Principle 3A (IPP3A) – in force from 1 May 2026

The Privacy Amendment Act 2025 introduced Information Principle 3A (IPP3A) into the Privacy Act 2020. IPP3A requires agencies to take reasonable steps to notify individuals when they collect their personal information indirectly — that is, from a source other than the individual themselves.

There may be times when we collect personal information about individuals from someone other than the individual i.e. third parties.  We will do this for the purpose of carrying out our legal services to our clients in accordance with our agreed retainer. We may obtain personal information from third parties such as other lawyers, lenders, insurers, co-borrowers, guarantors, accountants, trustees, beneficiaries, executors, Land Information New Zealand, Councils, New Zealand Companies Office, Personal Property Securities Register, NZ courts, tribunals, NZ regulatory bodies, third-party agents referred to above for the purpose of meeting our obligations under the AML Act, debt recovery organisations  and other third parties connected with the services we are providing to our clients.  We may also disclose your personal information to these third parties.

From 1 May 2026, when we collect your personal information from a third party, we are required to take reasonable steps to notify you of certain matters, unless an exception applies. We will endeavour to apply exceptions proportionately and in accordance with guidance from the Office of the Privacy Commissioner.

Security and Storage

Henderson Reeves will collect and hold your personal information and will take all reasonable steps to ensure your personal information is safe from loss, unauthorised use, modification, disclosure, and any other misuse.  The full name and address of Henderson Reeves is set out at the bottom of this Statement.

All information is stored electronically (requiring logins and passwords) or physically (in secured premises). Only authorised persons are permitted to access your personal information.

We will use, disclose or retain your personal information for as long as necessary to fulfil the purpose for which it was collected and as otherwise permitted or required by law.  These laws include the AML Act, the Lawyers and Conveyancers Act 2006, the Privacy Act 2020 and all other applicable laws to our legal practice.  In most cases, the collection will be mandatory.

Disclosure

We may need to disclose your personal information for the purpose of complying with our legal obligations, responding to your questions in relation to our services, or as otherwise stated at the time of collection. We will not disclose personal information, except in accordance with these purposes, without your consent.

We may disclose your personal information to third parties:

  • who perform checks that are necessary under law on our behalf;
  • who provide services and perform functions on our behalf (data storage providers, IT support providers and software providers);
  • from whom we may obtain information as set out above; and
  • who maintain databases against which your identity may be verified (this may include overseas recipients).

We may also disclose your personal information to anyone else specifically authorised by you.

Accessing your Personal Information

You have the right to access your readily retrievable personal information that we hold and to request that your personal information be updated or corrected.  There are provisions in the Privacy Act 2020 that relate to your access of, and our obligations to correct, such information.

You can contact us to request the access and correction of any personal information we hold about you. We may charge a fee for providing access and if so, we will advise you of the cost in advance.
